Because Giraffe (the "Service") allows Users to upload files and create shareable trips, it hosts Content created by its Users. The Operator acts as an intermediary under Section 79 of the Information Technology Act, 2000 and the Information Technology Rules, 2021: it does not publish, endorse, or pre-screen User Content, and it acts on valid notices and orders. The Operator respects intellectual-property rights and responds to valid complaints. This policy explains how to report Content believed to infringe a right, and how to contest a removal made in error. The terms "Service", "Operator", "User", and "Content" are used as defined in the Terms of Use.
Reporting infringing content
To report Content on the Service (for example, on a public share link or in an uploaded file) believed to infringe a copyright or other right, send a notice to legal@giraffe.land containing:
- The complainant's name and contact details.
- A description of the work or right said to be infringed.
- The URL, or sufficient detail to locate the specific Content.
- A statement of good-faith belief that the use is not authorized by the rights-holder, an agent, or the law.
- A statement that the information in the notice is accurate, and that the complainant is the rights-holder or authorized to act on their behalf.
- The complainant's signature (typed is acceptable).
Submitting a notice or counter-notice that is knowingly false or made in bad faith may result in liability and account action.
Operator response
The Operator aims to acknowledge a report within 24 hours and to act on valid notices promptly. Where the Operator receives a court order or government direction to remove unlawful Content, it will act within 36 hours, as required under India's Information Technology Rules, 2021. Action on a notice may include removing the Content or disabling the share link, and notifying the User who posted it.
Counter-notice
If Content was removed and the User believes the removal was in error, the User may reply to legal@giraffe.land with: contact details, identification of the removed Content and where it appeared, and a good-faith statement that the Content was removed in error or that the User has the right to use it. The Operator will review the counter-notice. If the counter-notice is valid and the original complainant does not pursue the matter within a reasonable period (for example, by providing notice of legal proceedings), the Operator may restore the Content.
Repeat infringers
The Operator may suspend or terminate the accounts of Users who repeatedly infringe the rights of others.
